Missouri Paves the Way for Cannabis Microbusinesses:
Early Release of Application Instructions and Forms
The Missouri Department of Health and Senior Services (DHSS) has released early instructions and sample forms for the application of cannabis microbusiness licenses. This comes ahead of the constitutional deadline of June 6, providing potential applicants with additional time to review the materials before the application period from July 27 to August 10.
The creation of a lottery process for granting a limited number of new small business licenses, known as "microbusinesses," was one of the tasks assigned to the DHSS when voters approved Amendment 3 in November 2022. Microbusinesses are marijuana facility licenses issued to eligible entities and individuals, with the aim of allowing marginalized or under-represented individuals to participate in the legal marijuana market.
Applicants must meet at least one eligibility criteria from Article XIV, Section 2 and cannot own another facility licensed by Missouri’s Division of Cannabis Regulation. The eligibility requirements include having a net worth of less than $250,000 and an income below 250% of the federal poverty level, having a valid service-connected disability card issued by the United States Department of Veterans Affairs, or being a person who has been affected by a non-violent marijuana offense.
The DHSS has also updated the Cannabis.Mo.Gov website to provide application information, eligibility requirements, and answers to frequently asked questions about microbusinesses. The website will soon be used to announce public education programming and targeted technical assistance.
In October 2023, six microbusiness licenses in each of the eight Missouri congressional districts will be issued, totaling 48 licenses. Of the six in each district, two will be microbusiness dispensaries, and four will be wholesale facilities. An additional 48 licenses will be issued in 2024, and another 48 in 2025.
The DHSS, as the state’s public health authority, also encourages consumers to consume cannabis with caution. They highlight the potential risks associated with cannabis use, including the dangers of operating a vehicle under the influence and the potential harm to developing brains in adolescents and young adults.
The early release of application instructions and forms for cannabis microbusiness licenses by the Missouri Department of Health and Senior Services marks a significant step towards fostering inclusivity and diversity in the state's legal marijuana market. This initiative not only opens up opportunities for marginalized and under-represented individuals but also sets the stage for a more competitive and vibrant cannabis industry in Missouri.
